Summary of the bill.
The bill proposes to amend Article 220 of the Criminal Procedure Code (Código Procesal Penal) to govern pre-charge agreements. These agreements are between the Public Prosecutor’s Office (Ministerio Público) and an accused person before the charge is filed. It sets out what the parties could agree on, the grounds on which the judge of guarantees could reject an agreement, and its effects on sentencing or the filing of charges. It also addresses sexual offenses involving minors or persons with disabilities and bars sentencing agreements in femicide cases.
